Terms and Conditions
These Terms and Conditions apply to services supplied by GEM Electrical & Mechanical Repairs, including enquiries, quotations, diagnostics, mobile visits, workshop repairs, postal repair and programming services, ECU and module work, data reading or recovery, cloning, airbag/SRS crash-data reset, appliance and circuit-board work, installations and related services.
1. Who we are and how a contract is formed
“GEM Electrical & Mechanical Repairs”, “we”, “us” and “our” refer to the service provider. “Customer”, “you” and “your” refer to the person or business requesting the service. Contact us at info@gemrepairs.co.uk or 07300 072614.
Website listings and initial estimates are invitations to request a service. A contract is formed when we accept your order or booking, confirm a quotation, or begin the work at your request. The agreed scope consists of the applicable product or service description, written quotation or confirmation, and these terms. If a specific written agreement conflicts with these general terms, the specific agreement takes priority for that job.
2. Consumer rights and service standard
Where you are a consumer, we will provide the agreed service with reasonable care and skill. Information we give you about the service, price and agreed timescale forms part of the contract where the law says it does. Your statutory rights under the Consumer Rights Act 2015 and other applicable consumer law are not excluded or restricted.
3. Customer authority and accurate information
You confirm that you own the vehicle, module, appliance, equipment, data or other item, or have the owner’s authority to instruct us. You must provide accurate contact, delivery, vehicle/item, fault and history information, including known water damage, impact, overheating, fire, corrosion, previous repairs, programming attempts, incorrect jump-starting, reverse polarity, intermittent faults or other relevant events.
You are responsible for obtaining any permission required from an owner, insurer, finance company, landlord, employer, site manager or other third party. We may refuse or pause work if ownership, authority, legality, safety or the requested outcome is unclear.
4. Compatibility checks and what to send
Compatibility can depend on exact part numbers, hardware and software versions, processors, memory types, security systems and vehicle configuration. A matching casing, connector or model name does not prove compatibility.
- Repair or crash-data reset: send the original electronic module specified in the listing.
- Cloning or data transfer: send both the readable original module and a compatible donor/replacement module, clearly labelled “ORIGINAL” and “DONOR”.
- Data reading or recovery: send the agreed module or PCB and clearly describe the required output.
- Do not send unrelated components, airbags, inflators, seat-belt pretensioners, batteries or hazardous items unless specifically agreed.
5. Unknown and pre-existing condition
Postal and bench-service items are received outside the complete vehicle, appliance or system. We normally cannot establish their full condition, functionality, repair history or remaining life before receipt, and bench testing cannot reproduce every in-vehicle or in-system operating condition.
An item may arrive dead, intermittent, previously damaged, incorrectly programmed, contaminated, corroded, burnt, physically weakened, beyond economic repair, or with several unrelated faults. One visible or reported fault may conceal other defects. A successful read, reset, clone, test or repair does not prove that every circuit, component, data area, connected system or the complete vehicle is fault-free.
Unless we expressly confirm otherwise in writing, our receipt of an item is not confirmation that it worked before delivery or that the reported fault is accurate.
6. Inherent risks of diagnosis, opening and repair
Electronic and mechanical diagnosis and repair may require power-up testing, opening sealed housings, removing protective compounds, soldering, desoldering, reading or writing memory, applying programming voltage, dismantling, cleaning, heating, replacing components or repeated functional testing. These processes can reveal or accelerate a latent failure in an already defective, degraded, contaminated, previously repaired or physically weakened item.
By authorising the agreed work, you acknowledge the ordinary and unavoidable risks explained above, including that an item which was partly working or intermittent may stop communicating or fail completely during a properly performed diagnostic or repair attempt. We are not responsible for deterioration, loss of function or failure caused by the item’s pre-existing condition, latent defect, corrupted data, previous work, normal fragility or an inherent risk of the authorised procedure where we have used reasonable care and skill.
This does not exclude responsibility for damage directly caused by our failure to use reasonable care and skill, or any other liability that the law does not allow us to exclude.
7. Diagnosis, attempted repair and no-fix outcomes
Diagnosis identifies faults only to the extent reasonably possible using the item, information, access and test conditions available. It is not a guarantee that every fault will be found. A diagnostic, inspection, bench, call-out or attempted-repair charge pays for the agreed time, testing, expertise and procedures, not solely for a successful outcome, provided that charge was disclosed before agreement.
We do not guarantee that every item can be repaired, read, reset, cloned, recovered or made compatible. If the agreed procedure cannot be completed, we will explain the outcome where reasonably possible and tell you about any further option or charge before additional work.
8. Quotations, prices and additional work
An estimate given before inspection may change if the item differs from the description, additional faults are found, specialist parts or procedures are required, or the customer changes the scope. We will request approval before carrying out additional chargeable work or purchasing additional parts not included in the agreed price.
Website cloning prices cover the advertised cloning or data-transfer labour only unless expressly stated otherwise. A donor module is not included. If you ask us to source a donor, we will identify a proposed item where possible and obtain your approval for its price before purchasing it. Donor availability and compatibility cannot be guaranteed.
9. Customer-supplied and sourced parts
We may refuse a customer-supplied part that appears unsafe, unsuitable, counterfeit, damaged or incompatible. We are not responsible for defects inherent in a customer-supplied part or donor. Additional labour caused by an incorrect or faulty supplied part may be chargeable if agreed.
Where we supply a part, it will be as described and any applicable statutory rights remain in place. Special-order or uniquely matched parts may not be reusable for another customer; cancellation and refund rights will be applied in accordance with the law and the circumstances of the order.
10. Data, coding and programming
You should retain any available backup before sending a device or authorising work. Programming, cloning, data transfer and recovery are performed on an attempt basis where the source data or hardware is faulty. Data recovery cannot be guaranteed, particularly where memory is physically damaged, encrypted, overwritten, corrupted or unreadable.
We will take reasonable care with data in our control, but we are not responsible for data already missing, corrupted or inaccessible before our work, or for loss caused by a pre-existing hardware/data fault or an inherent risk of an authorised procedure performed with reasonable care and skill. Vehicle coding, online manufacturer authorisation, immobiliser adaptation, calibration and installation are not included unless expressly stated.
11. Airbag and SRS services
An airbag/SRS crash-data reset processes supported stored crash or deployment data in the customer’s original electronic SRS control module. It is not a repair or replacement of deployed airbags, pretensioners, impact sensors, wiring, clocksprings, occupancy systems or other safety components.
Before a vehicle returns to service, all collision damage and SRS faults must be diagnosed and repaired by a suitably competent person. The customer is responsible for correct removal, refitting, coding, calibration, fault-code clearing and confirming that the complete SRS system operates safely. A reset alone does not guarantee that an airbag warning light will extinguish.
12. Removal, installation and complete-system testing
For postal bench services, the customer is responsible for correct diagnosis, safe removal, refitting and any required coding, calibration or relearning unless those services are expressly included. We cannot carry out a complete in-vehicle or in-system test when only a module or component is supplied.
For mobile or on-site work, the customer must provide safe, lawful access, suitable working space, accurate location details and known hazard information. We may stop or rearrange work where conditions are unsafe or outside the agreed scope or competence.
13. Sending items to us
You are responsible for choosing a suitable outbound carrier, complying with its rules, using adequate anti-static protection and cushioning, protecting connectors, and packing the item in a strong box. Include your order number and contact details, but do not place passwords or unnecessary personal information in the parcel.
Until an outbound parcel is delivered into our possession, any claim for loss or transit damage normally needs to be made under the contract with the carrier selected by the sender. Please retain tracking, photographs of the item and packaging, proof of value and proof of posting.
14. Return delivery and Evri parcel cover
Where shown at cart or checkout, return delivery is arranged through Evri. Evri provides the applicable carrier parcel cover, subject to Evri’s current terms, eligibility rules, prohibited and non-compensation items, packaging requirements, evidence requirements and claim decision. This cover is not a separate guarantee or insurance policy provided by GEM Electrical & Mechanical Repairs.
- Evri generally includes cover up to £20 for eligible parcels.
- If offered at checkout, you may purchase enhanced cover for the declared value up to the displayed maximum of £999.99.
- Enhanced cover applies only if selected and paid for before dispatch and only to the extent Evri accepts the item and claim as eligible.
- Declaring a value does not by itself guarantee compensation. Poor packaging, excluded contents, missing proof or other carrier exclusions may invalidate a claim.
If a return parcel is lost or damaged, notify us promptly and provide requested evidence. We will make or assist with the carrier claim where appropriate. Any carrier compensation is determined by Evri under its terms. Nothing here restricts rights you may have against us where loss or damage was caused by our breach of contract or failure to use reasonable care.

15. Turnaround and delays
Turnaround times are estimates unless expressly guaranteed in writing. They may be affected by compatibility, condition, diagnostics, parts, customer approval, carrier delays, workload, third-party systems or unsuccessful procedures. We will complete the service within the agreed time or, if none was agreed, within a reasonable time.
16. Online and distance-order cancellation
If you are a consumer buying at a distance, you normally have 14 days from formation of a service contract to cancel without giving a reason, subject to statutory exceptions. Contact info@gemrepairs.co.uk with your order details to cancel.
If you expressly ask us to begin during the cancellation period and then cancel before completion, you may have to pay a proportionate amount for work supplied up to cancellation. Once a service has been fully performed following your express request and acknowledgement, the statutory cancellation right may be lost. These provisions do not affect rights relating to a service that was not supplied with reasonable care and skill.
17. Payment, storage and uncollected items
Payment is due as stated in the listing, quotation, invoice or booking confirmation. We may retain an item until sums properly due for the relevant service are paid, subject to applicable law.
Please respond to collection, payment and return requests promptly. If an item remains uncollected or cannot be returned because you do not provide instructions, payment or a valid address, reasonable storage and redelivery costs may be charged after notice. We will not dispose of or sell an uncollected item except after reasonable written notice and in accordance with applicable law. Sale proceeds, after lawful costs and sums due, will be handled as the law requires.
18. Results, warranties and unrelated faults
Any workmanship warranty stated in writing applies only to the specific agreed repair and period. It does not cover unrelated or later faults, normal wear, misuse, accident, water/fire/corrosion, incorrect installation, vehicle or wiring faults, customer-supplied parts, software updates, third-party interference, tampering or a condition disclosed as outside the repair scope.
No statement guarantees that an old, damaged or previously repaired item will have the life or reliability of a new unit. If you believe our agreed work is defective, contact us promptly, stop using the item if continued use may cause harm, and give us a reasonable opportunity to inspect and, where legally appropriate, repeat or remedy the service.
19. Responsibility and losses
We are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for loss caused by inaccurate customer information, unauthorised instructions, unsuitable customer-supplied parts, failure to follow advice, faults outside the agreed scope, pre-existing or latent conditions, or inherent risks properly disclosed and encountered despite reasonable care.
For consumers, we do not exclude or restrict liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of statutory consumer rights.
If you are acting wholly or mainly for business purposes, we are not responsible for indirect or consequential loss, loss of profit, revenue, contracts, business opportunity or business data unless expressly agreed in writing, except where liability cannot lawfully be limited.
20. Complaints and disputes
Please report a service complaint to info@gemrepairs.co.uk with your order or booking reference, the problem and the outcome requested. We will investigate and respond within a reasonable time. Data-protection complaints are handled under our Privacy Policy.
These terms are governed by the law applicable in the part of the United Kingdom where you live or, for a business customer, the law of England and Wales unless agreed otherwise. Consumers may bring proceedings in the courts available to them under applicable law.
21. General
If any term is found unlawful or unenforceable, the remaining terms continue to apply. A delay in enforcing a right does not waive it. No person other than the customer and GEM Electrical & Mechanical Repairs has a right to enforce the contract except where the law provides otherwise.
We may update these website terms for future orders when services, carriers or laws change. The terms applicable to an accepted order are those made available when the contract was formed, together with any later change expressly agreed by both parties.
Health and Safety Policy
GEM Electrical & Mechanical Repairs aims to protect customers, workers, visitors, the public, property, vehicles and equipment by identifying hazards and using controls proportionate to each job.
Responsibilities and safe working
Our responsibilities
- Assess foreseeable risks before work and review them if the task or conditions change.
- Use suitable tools, test equipment, PPE, extraction, lifting and access equipment.
- Work only within the competence, authority, information and facilities available.
- Isolate or control electrical, mechanical, thermal, hydraulic, chemical and stored energy.
- Stop, make safe and refer work where risk cannot be adequately controlled.
Customer and site responsibilities
- Give accurate fault, vehicle, item and site information and disclose known hazards or previous work.
- Confirm authority to instruct the work and provide safe, lawful access.
- Keep children, pets, visitors and other trades away from the controlled work area.
- Tell us about asbestos, gas, water, damaged wiring, fragile surfaces, traffic, security or site rules before work starts.
- Follow safety instructions and do not energise, move or use equipment being worked on.
Risk assessment and RAMS
We use a proportionate assessment for routine work and a recorded, job-specific RAMS document where the risk, customer, site or contract requires it. A dynamic check is made on arrival and work is reassessed when conditions change. The RAMS tab is a template only and must not be adopted without completing it for the actual job.
Electrical, appliance and installation work
Risks include electric shock, burns, arcing, fire, damaged cables, stored charge, heat, moving parts, water and unsuitable supplies. Isolation and proving dead are used where appropriate; protective devices are not bypassed. Drilling, cutting and fixing are planned around hidden services. Work at height is avoided where practicable and suitable access equipment is used when required. Gas, refrigerant, asbestos-related or other regulated specialist work is only undertaken when legally permitted and suitably competent, otherwise it is stopped and referred.
Vehicles, lifting and mobile work
Vehicles must be in a safe, stable and lawful location with adequate space. Controls may include securing keys, preventing unintended starting or movement, parking brake and wheel chocks, rated lifting points and equipment, axle stands, traffic separation and high-visibility clothing. Nobody works beneath a vehicle supported only by a jack. Roadside or site work is declined or stopped when traffic, weather, ground, lighting or access makes it unsafe.
Electric, hybrid and battery systems
High-voltage and battery systems can cause fatal electric shock, arc injury, chemical exposure, fire and unexpected vehicle movement. High-voltage work is undertaken only with the competence, procedures, information, tools and PPE appropriate to the task. Damaged, hot, swollen, leaking or unstable batteries are isolated from ignition sources and the work may be refused, quarantined or referred. Terminals are protected against short circuit and batteries are handled and stored for their chemistry and condition.
SRS, airbags and pyrotechnic devices
Our postal SRS service is for an electronic control module, not a complete airbag, inflator or seat-belt pretensioner. Customers must not post or deliver undeclared pyrotechnic devices. Any SRS component is treated as safety-critical; it is protected against impact, static, heat and unintended activation, and work outside our safe scope is refused or referred.
Electronics bench and postal items
ECUs, BCMs, clusters, keys, computers and circuit boards are handled with electrostatic-discharge precautions where appropriate. Current-limited supplies, insulated tools, eye protection and local fume extraction are used according to the work. Hot-air, soldering, cleaning chemicals, sharp casings and charged capacitors are controlled. Incoming parcels are inspected for visible damage, leakage, heat, odour or unsafe contents before normal handling.
Manual handling, tools, fire and emergencies
Loads are assessed for weight, shape, stability and route; assistance or handling equipment is used where needed. Guards and safety features remain in place, and work areas, leads and escape routes are kept orderly. Suitable first-aid and fire arrangements are maintained for the work undertaken. Work stops immediately for fire, electric shock, gas smell, battery thermal event, uncontrolled leak, injury or another serious danger, and emergency or utility services are contacted where required.
Incidents and review
Accidents, near misses, damage and safety concerns are recorded and reviewed in proportion to their seriousness. Statutory reports are made where legally required. This policy and related risk controls are reviewed after significant change or incident and periodically as services and guidance develop.

Record likelihood (1–5) × severity (1–5) before controls and again after controls. Do not start where residual risk is unacceptable. Record who will implement each action and by when.

4. Method statement
- Plan: confirm authority, scope, item identity, history, technical information, competence, parts, tools, permits and emergency arrangements.
- Inspect: check the site, parcel, vehicle or equipment for damage and unexpected hazards; record the starting condition.
- Control: establish the work area, isolate energy, secure vehicle/keys, protect property and data, and install extraction, access or lifting controls.
- Perform: follow manufacturer information and the approved job sequence; do not bypass safety systems or extend the work without reassessment and approval.
- Test: restore energy in a controlled way, keep people clear, test only the agreed functions and record results and limitations.
- Finish: leave the item/site safe, account for tools and parts, manage waste correctly, hand over warnings and outstanding work, and close permits or access.
5. PPE, emergency and approval record
List task-specific PPE; do not use PPE as a substitute for elimination, isolation or engineering controls. Record emergency actions for shock, fire, battery thermal event, spill, injury and vehicle movement, including who raises the alarm. The assessor and person carrying out the work must sign/date the final RAMS, and changes must be briefed and recorded.
Quality Assurance Policy
GEM Electrical & Mechanical Repairs aims to provide services with reasonable care and skill, a clear agreed scope, careful handling, proportionate testing and honest communication about results and limitations.
Quality process
- Enquiry and identification: record the customer’s symptoms, requested result, item/vehicle details, urgency and relevant history.
- Scope and price: explain the service included, exclusions, diagnostic or staged charges, customer-supplied parts and when further approval is needed.
- Starting condition: inspect and document visible condition where practicable. A postal or dismantled item may have hidden or multiple pre-existing faults that cannot be established before work.
- Diagnosis and work: use a logical method, suitable information and equipment; protect property and do not knowingly perform unrelated additional work without consent.
- Parts and data: identify customer and donor items, record relevant part details and use agreed new, used, refurbished or customer-supplied parts.
- Testing: test the agreed functions within the facilities available. Bench testing is not always equivalent to testing in the original vehicle, appliance or installation.
- Handover: state what was done, test results, limitations, outstanding faults, coding/adaptation needs, safe-use advice and recommended next steps.
- Records and improvement: retain appropriate job, approval, test and supplier records and review repeat faults, complaints and near misses.

Customer-supplied parts and donor modules
Compatibility, condition and authenticity of customer-supplied items cannot be guaranteed by us. We will raise an apparent mismatch or defect when found. If a donor or replacement must be sourced, we will seek the customer’s agreement to the proposed item and additional cost before purchase wherever practicable.
Non-conforming work and complaints
If a result does not meet the agreed scope, we record the issue, make the item safe where necessary and explain the available next step. Customers should report concerns promptly with the order or invoice number and supporting information. We will assess the original scope, starting condition, test evidence, parts, subsequent interference and applicable legal rights before proposing an appropriate remedy.
Equality, Diversity and Environmental Policy
GEM Electrical & Mechanical Repairs aims to provide respectful, fair and practically accessible services while reducing avoidable waste and managing hazardous materials responsibly.
Equality and respectful service
We do not tolerate unlawful discrimination, harassment or victimisation. In providing services, we take account of the protected characteristics under the Equality Act 2010: age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex and sexual orientation.
Access and communication
- Use clear, respectful communication and offer information in a practical alternative format where reasonably possible.
- Consider reasonable adjustments for disabled customers, including communication, appointment and handover arrangements.
- Respect dignity, privacy, cultural or religious needs and the customer’s preferred method of contact where practicable.
- Invite customers to tell us what adjustment would help; not every requested adjustment will be safe, practicable or reasonable.
Fair decisions
- Apply prices, booking rules and quality standards consistently, subject to the actual scope and risk.
- Base any refusal or stop-work decision on safety, legality, competence, capacity, abusive conduct, non-payment or the requested work—not a protected characteristic.
- Keep equality-related information confidential and use it only where relevant and lawful.
- Review concerns promptly and do not disadvantage someone for raising a good-faith complaint.
Environmental priorities
- Repair and reuse: repair, recover data and reuse suitable parts where safe, lawful, economical and agreed, instead of automatically replacing complete equipment.
- Parts and donor units: keep customer, donor and exchange items identified; agree whether removed parts are returned, retained for an agreed core/exchange arrangement or responsibly disposed of.
- Packaging and transport: reuse suitable packaging, minimise unnecessary material and combine purchasing or journeys where practicable. Postal and courier use is selected for the task, but transport still has an environmental impact.
- Energy and consumables: avoid unnecessary idling and test-bench operation, control spills and use chemicals, solder and cleaning products only in the quantities needed.
- Digital work: use electronic estimates, invoices, records and remote support where appropriate, while retaining information only as needed under our Privacy Policy.
Electrical, battery and hazardous waste
Items intended for reuse or return to a customer are controlled as customer goods. When an item becomes waste, it is classified, stored and transferred according to the rules that apply. Waste circuit boards, computers, modules and electrical equipment are segregated for an appropriate WEEE route. Batteries are protected from short circuit, damage, heat and leakage and passed to a suitable authorised collection or treatment route. Oils, brake fluid, solvents, refrigerant-containing equipment and other hazardous materials receive appropriate containment and documentation.
SRS and unsafe items
Complete airbags, inflators and seat-belt pretensioners are pyrotechnic safety devices and are not accepted through our normal postal module service. Customers must accurately declare parcel contents and comply with carrier restrictions. Leaking, fire-damaged, swollen or otherwise unstable batteries and contaminated items may be refused or isolated pending specialist advice.
Waste duty of care
Business waste is kept secure, described accurately and transferred only to a person or facility authorised to receive it, with waste-transfer or hazardous-waste records retained where required. We do not dispose of customer items merely because a repair is uneconomic without following the contract, customer instructions and applicable law.

Customers may contact us to request an adjustment or raise an equality or environmental concern. We will consider the facts, respond respectfully and take proportionate corrective action where appropriate. These commitments are reviewed as the business, waste routes, services and legal guidance change; they do not replace job-specific risk assessments, permits, registrations or statutory duties.
